All companies offering products or services to consumers (B2C) are affected — regardless of industry. Exceptions: micro-enterprises with fewer than 10 employees and under €2 million in annual revenue. B2B companies are also affected if their products can be used by end consumers. Banking, insurance, telecommunications, e-commerce, and passenger transport are explicitly included.
The requirements are based on the WCAG 2.1 Level AA guidelines. In concrete terms: sufficient color contrast (at least 4.5:1 for text), keyboard operability of all functions, meaningful alt texts for images, subtitles for videos, screen-reader-compatible forms, and clear, consistent navigation. In addition, every website must include an accessibility statement in plain language.
The market surveillance authority can impose fines for violations, scaled to company revenue — similar to the GDPR, with up to €100,000. More serious: competitors can issue cease-and-desist warnings, and affected consumers have a right to sue. The first waves of warning letters are expected for fall 2025.
